What right do I have to confidentiality?
A thorough investigation of your finances, criminal history, education, employment history, health, substance abuse and family responsibility will be conducted and made known to the court.
Will I still be under supervision?
This is a decision made by the court in all cases and will depend upon whether you are considered a risk of non-appearance or danger to yourself or to the community. If you are under supervision at the time of the determination of guilt and have complied with all its conditions, the court may allow you to continue under supervision. The court will seek and receive a recommendation from the pretrial services officer but is not bound by that recommendation.
Will my release conditions change after a determination of guilt?
In making a decision on this the court will consider several issues including your compliance with the conditions placed upon you prior to the plea. It is important that you establish a relationship of cooperation and trust with your pretrial services officer.
How long will it be before I am sentenced?
The judge may set a date for sentencing at the time of the plea but is not required to do so. More information is needed for a fair and just sentence. To that end the judge will order a presentence investigation be conducted and a report be prepared. A probation officer will be assigned to meet with you, conduct the investigation, then prepare a presentence report and recommendation. Your truthful and cooperative answers to questions of the presentence investigator will greatly influence the efficiency of the verification process. The level of complexity of the case may lengthen or shorten the time required for this investigation.
Can I keep my guns?
If you are convicted of a felony you will not be allowed to own or possess or use firearms or ammunition. It may be wise to consult with your attorney so he/she can explain the restrictions cited in 18 U.S.C. 922.
Will I be able to continue with my job?
If you are allowed to remain free under pretrial supervision you will be allowed and expected to continue employment to support yourself and your family.
